This document defines the terms and conditions for subscriptions to The Thomas Jefferson Heritage Society’s online edition, which are available at this time only to individuals for their private, noncommercial use ("Individual Subscribers"), and not to institutions for multi-person use.

DISCLAIMER OF WARRANTIES

You expressly understand and agree that your use of the service is at your sole risk. The service is provided on an “as is” and “as available” basis. The Thomas Jefferson Heritage Society (hereafter Publisher) expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

LIMITATION OF LIABILITY

You expressly understand and agree that Publisher shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service. without limiting the foregoing or any other limitation of liability in this agreement, you agree that under no circumstance shall the liability of Publisher under this agreement exceed the amount of the annual subscription fee paid by you.

DOWNLOADING AND COPYING; RESTRICTIONS ON USE

All materials on this site (“Online Material”), including, without limitation, names, logos, trademarks, service marks, images, articles, graphics, photographs, illustrations, artwork, audio clips, video clips, software, and other elements making up the Service are protected by copyrights and other intellectual property rights owned and controlled by Publisher or by other parties that have licensed their material for reproduction by Publisher. You may download or copy the Online Material for noncommercial personal use only, provided that you maintain all copyright and other notices contained therein. Copying or storing of any Online Material for other than noncommercial personal use by you is expressly prohibited without prior written permission from Publisher or the copyright holder identified in the copyright notice contained in the content. You may not add, delete, distort, or otherwise modify the content on this site. The Thomas Jefferson Heritage Society’s logo and name “The Journal of Thomas Jefferson’s Life and Times” are trademarks of The Thomas Jefferson Heritage Society.

NON-WAIVER; SEVERABILITY; LIMITATIONS OF ACTIONS

The failure of The Thomas Jefferson Heritage Society to exercise or enforce any right or provision of the terms of service shall not constitute a waiver of such right or provision. If any provision of the terms of service is found by a court of competent jurisdiction to be invalid or unenforceable, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

INDEMNIFICATION

You agree to indemnify, defend and hold The Thomas Jefferson Heritage Society harmless from any claims and expenses, including reasonable attorneys’ fees, arising from or related to any breach by you of any terms of this Agreement.

LETTERS TO THE EDITOR OR OTHER SUCH COMMENTS OR MATERIALS

Any comments, materials, or letters sent by you to The Thomas Jefferson Heritage Society regarding the site or its content, including questions, comments, suggestions, criticisms or the like (“Received Materials”) shall be deemed to be non-confidential and free of any claims of proprietary or personal rights unless you explicitly state in the correspondence that the letter is “not for publication” and contains “private and proprietary” information that may not be distributed. The Thomas Jefferson Heritage Society shall have no obligation of any kind with respect to such Received Materials and The Thomas Jefferson Heritage Society will be free to reproduce, use, disclose, exhibit, display, transform, edit, abridge, create derivative works from and/or distribute the Received Materials without limitation or restriction.

ENTIRE AGREEMENT

This Agreement and any other terms and conditions of service on thethomasjeffersonjournal.org constitute the entire agreement between you and The Thomas Jefferson Heritage Society and govern your use of the Service.

REFUSAL OR DISCONTINUANCE OF SERVICE
The Thomas Jefferson Heritage Society reserves the right to refuse or discontinue service to any user for non-compliance with these Terms of Service.

When does tjheritage.org collect my personal information?


The Thomas Jefferson Heritage Society gathers information from subscribers and visitors via voluntary registration, cookie technology, and IP addresses.

Registration: When you create an account on tjheritage.org, we collect information that helps us identify you. At the initial registration screen we ask for your name, your email address, and a password. When you order something from us such as a book or a subscription, we also ask for your name, shipping address, telephone number, and your credit card number and expiration date. This information is necessary for us to process your order. We will not share any of this personal information without your consent.

Cookies: A cookie is a message sent to your browser from a Web server and stored on your computer’s hard drive. Most Internet sites use cookies. We use cookies to store and track your preferences; for instance, to remember what you have placed in your shopping cart. You can set your browser preferences to reject all cookies, but this will prevent you from using most customized services. Cookies make your experience easier by saving your preferences and passwords.

IP address: An IP address is a number that is assigned to your computer automatically when you use the Internet. When you visit a particular webpage on The Thomas Jefferson Heritage Society’s site, our server logs your IP address. We may log IP addresses for the purposes of systems administration, or to report information in aggregate form to our retail partners and advertisers (e.g., how many visitors logged in to our Web site) in a form that is not personally identifiable.
 
Who does The Thomas Jefferson Heritage Society share information with?

We will not disclose your personal information to third parties, except to the extent necessary to provide you with a requested service, or under circumstances required by law. We will disclose your personal information when we believe in good faith that any applicable law, regulation, or legal process requires it, or where we believe disclosure is necessary to protect or enforce our rights or the rights of another member. We also disclose aggregated member statistics in order to describe our services and audience to prospective partners, advertisers, and other third parties. However aggregate data is not traceable to you specifically.
 
What are my options to control the use of my personal information?

Most browsers can be configured to reject cookies or alert you when cookies are being sent. You may cancel your registration to The Thomas Jefferson Heritage Society and/or request the removal of your personal Information from our member records by sending email to  tjhs@tjheritage.org. We will send an email to confirm your request. After you respond, we will remove your information from our database. Residual information may remain in our archives and records, but this information will not be used for a commercial purpose. We reserve the right to maintain information on registered members who have violated our terms and conditions, or who have had their access to The Thomas Jefferson Heritage Society blocked, in order to detect repeat offenders.
 
What else should I know about my privacy?

You should be aware that if you voluntarily disclose personal information online in a public area, that information might be collected and used by others. We do not control the actions of our visitors and registered users. If you disclose personal information in a forum or any other publicly accessible place on The Thomas Jefferson Heritage Society’s site, you do so at your own risk and you understand that your information may be collected and used by others. Please remember that protection of your privacy begins with you. You are solely responsible for maintaining the secrecy of any password you use to register, and you should always be careful and responsible whenever disclosing information online.

This Web site has security measures in place to protect the loss, misuse, and alteration of the information under our control. When you place orders we use a secure server, which encrypts all information you input before it is sent to us. All of the customer data we collect is similarly protected against unauthorized access.
